Trap Loan Agreement

This Trap Loan Agreement (“Agreement”) is entered into between Kitty’s Haven Helpers and the undersigned caretaker (“Caretaker”) for the temporary loan of humane live traps to be used exclusively for Trap-Neuter-Return (TNR) activities.

This Agreement is intended to supplement and expressly reference the Kitty’s Haven Helpers TNR Service – Terms and Conditions, which are incorporated herein by reference. All caretakers must comply with both documents.

 


1. Purpose of Trap Loan

Traps are loaned solely for the purpose of humanely trapping free-roaming, community, or feral cats for participation in Kitty’s Haven Helpers TNR services within approved service areas, primarily Oconee County, South Carolina.

Traps may not be used for:

  • Domestic pets

  • Wildlife

  • Relocation efforts

  • Any purpose outside of approved TNR activities

 


2. Trap Ownership

  • All traps remain the sole property of Kitty’s Haven Helpers at all times.

  • This Agreement does not transfer ownership or create any property interest for the Caretaker.

 


3. Caretaker Responsibilities

The Caretaker agrees to:

  • Use only humane live traps approved by Kitty’s Haven Helpers.

  • Follow all trapping instructions, safety protocols, and best practices provided.

  • Monitor traps frequently and never leave traps unattended for extended periods.

  • Keep traps clean, dry, secure, and protected from weather while in use and during storage.

  • Ensure traps are placed in safe locations to prevent injury to cats, people, or property.

 


4. Housing & Post-Surgery Use

  • Traps may be used for short-term confinement during post-operative recovery as outlined in the TNR Service Terms and Conditions.

  • Cats must be housed safely and humanely until approved for release.

  • Traps must never be opened, altered, or used in a manner inconsistent with post-operative care instructions.

 


5. Loss, Damage, or Theft

  • The Caretaker assumes full responsibility for all traps while in their possession.

  • Lost, stolen, or damaged traps must be replaced by the Caretaker at full replacement cost.

  • Normal wear and tear excepted, any damage affecting trap safety or function is considered chargeable.

 


6. Prohibited Actions

The Caretaker shall not:

  • Modify, alter, or repair traps without written approval

  • Loan or transfer traps to another individual or organization

  • Use traps outside of approved service areas

  • Use traps in a negligent, abusive, or unsafe manner

 


7. Return of Traps

  • Traps must be returned clean and in good working condition by the agreed return date.

  • Failure to return traps may result in replacement charges and denial of future services.

 


8. Liability Waiver

The Caretaker acknowledges that trapping feral and community cats involves inherent risks. By signing this Agreement, the Caretaker:

  • Assumes all risks associated with trap use, transport, and storage.

  • Releases and holds harmless Kitty’s Haven Helpers, Kitty’s Kitten Rescue, volunteers, and partners from any liability arising from the use or possession of traps.

 


9. Termination

Kitty’s Haven Helpers reserves the right to terminate this Agreement immediately if the Caretaker fails to comply with this Agreement or the referenced TNR Service Terms and Conditions.

 


10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina, with venue proper in Oconee County, South Carolina.

 


11. Acknowledgment & Signature

The Caretaker acknowledges that they have read, understand, and agree to the terms of this Trap Loan Agreement and the Kitty’s Haven Helpers TNR Service – Terms and Conditions.
